EMPLOYER GUIDE - DUTIES
An employer should apply for coverage under the ESI Act through the website esic.in within 15 days after the Act becomes applicable to their factory or establishment.
A covered employer should register all coverable employees in the unit by submitting Declaration Form for them - online, through the website esic.in - and obtain Insurance Numbers for them.
The employer should print Temporary Identity Certificate for the registered employees after registration and hand it over to the employees after attesting the photograph of the employee and their family affixed on it.
The employees should be directed to obtain Permanent Identity Card - or Pehchan Card - by visiting the Pehchan Camps being run at all ESIC Branch Offices.
The employer should submit Monthly Contribution return - online, through the website esic.in - and pay the Contribution for both the employees and employer as per specified rates for each month within 21 days of the following month.
The employer should maintain an Accident Book and submit Accident Reports of accidents involving insured workers on the job to the Branch Office, within 24 hours of an accident.
The employer should maintain all such records and registers as are required under the Act and produce them for verification/inspection before the authorized officers of the Corporation.
The employer should facilitate proper inspection of records/registers and the premises by visiting officers of the ESI Corporation as and when so required.
The employer should ensure that ESI Contribution is paid in respect of all contract, badli and casual workers also who are drawing wages upto Rs 15,000/- a month excluding remuneration for overtime.
The employer should promptly report the date of closure of their factory/establishment to the ESIC Branch/Regional/Sub-Regional Office, preferably within seven days of such closure and clear ESI liabilities.
The employer should report any change in business activity, address, ownership or the management to ESIC authorities forth with.
The employer will submit yearly return in Form 01A in respect of their factory/establishment every year.
An employer should also ascertain the liability towards ESI dues while taking over the ownership of a factory/establishment through purchase, gift, lease, license or otherwise as the new owner is liable to discharge past liabilities.
